Marriage and divorce in Turkey and its impact on the asylum file for Syrians

 






Turkish law applies to all marriage procedures for asylum seekers, refugees and stateless persons that will take place in Turkey.

Under Turkish law, Turkish authorities can marry a Turkish citizen

 Asylum seekers, refugees, stateless persons, two asylum seekers, or refugees of different nationalities.

 All marriages performed by the Turkish authorities are governed by the Turkish Civil Code and related regulations.




Legal penalties for underage marriage


Informal "marriage" with a child is considered child abuse under the Turkish Penal Code.

 Its perpetrators are punished, including with prison sentences.


State institutions, health and education institutions, as well as organizations

NGOs report to the Turkish authorities about a child facing any kind of protection risk.

Documents required for marriage


In order to get married, the following documents must be submitted to the municipal marriage departments:


Marriage Petition: The spouses must submit a marriage petition (called “Evlanmeh Bayanamezi” in Turkish),

 Signed by both applicants for marriage.

A certificate of celibacy proving that the applicants are not already married previously;

A medical report confirming that the applicants are free of diseases that prevent them from getting married.

The applicant's registration document for international protection. Identity document of the international applicant for protection;

 The identity document of the holder of international protection; or a temporary protection identity document;

four pictures.



Divorce in Turkey


It is possible to obtain a divorce in Turkey, even if the marriage took place outside Turkey. Turkish Legislation

refugees and stateless persons. Asylum seekers, refugees and stateless persons who wish to divorce are subject to divorce in Turkey in accordance with the provisions of the Turkish Civil Code.
